Memo spells out when it's OK to kill Al Qaeda-linked Americans without trial

WASHINGTON—The White House and its critics faced off Tuesday over the legality of drone strikes to kill U.S. citizens abroad, in a likely preview of arguments that will be raised during this week’s confirmation hearing for President Barack Obama’s choice to head the CIA.

The disclosure of an unclassified Justice Department memo laying out the legal framework for the U.S. government’s ability to attack its own citizens drew criticism from civil liberties groups. But the White House strongly defended the controversial policy as legal and ethical.

The memo, first obtained by NBC News, argues that drone strikes are justified under American law if a targeted U.S. citizen had “recently” been involved in “activities” posing a possible threat and provided there is no evidence suggesting the individual “renounced or abandoned” such activities. A top U.S. official must determine that the targeted person “poses an imminent threat of violent attack against the United States,” cannot be captured, and that the strike “would be conducted in a manner consistent with applicable law of war principles.”

White House spokesman Jay Carney defended current U.S. drone policy, saying they are used to mitigate threats, stop plots, prevent future attacks and save American lives. “These strikes are legal, they are ethical and they are wise,” he said. Civil liberties groups expressed concerns, while lawmakers called on the White House to release more of its legal underpinning for the assertion that the president has the power to kill U.S. citizens abroad without trial.

“My initial reaction is that the paper only underscores the irresponsible extravagance of the government’s central claim,” Jameel Jaffer of the American Civil Liberties Union wrote on the ACLU’s blog. “Even if the Obama administration is convinced of its own fundamental trustworthiness, the power this white paper sets out will be available to every future president.”

The use of drones figures to be a prime topic for White House counterterrorism chief John Brennan when he faces the Senate Intelligence Committee on Thursday in a confirmation hearing on his nomination to become CIA director.

The U.S. government has dramatically increased its use of drones abroad in recent years to target Al Qaeda figures in far-flung places from Pakistan to Yemen.

The document was disclosed as a bipartisan group of U.S. senators called on the Obama administration to release to Congress “any and all” legal opinions laying out the government’s understanding of what legal powers the president has to authorize the killing of American citizens.

The senators who signed the letter, including members of the Senate Intelligence Committee, said the administration’s co-operation would “help avoid an unnecessary confrontation that could affect the Senate’s consideration of nominees for national security purposes.”

One national security official said the leak of the Justice Department memo may have been timed to blunt such congressional demands for the release of additional documents. Sen. Dianne Feinstein, the Democrat who chairs the Intelligence Committee, said in a statement on Tuesday that she had been calling on the administration to release legal analyses related to the use of drones for more than a year. Feinstein said the document obtained by NBC had been given to congressional committees last June on a confidential basis, and that her committee is seeking additional documents, which are believed to remain classified.

Attorney General Eric Holder on Tuesday said he was concerned that the release of more documents could put sources and operations at risk.

There is “a real concern to reveal sources, to potentially reveal sources and methods and put at risk the very mechanisms that we use to try to keep people safe, which is our primary responsibility,” he said at a news conference.

The memo is drawing new attention to the 2011 strike that killed U.S.-born Anwar al Awlaki, who U.S. investigators say was a major player with Al Qaeda’s Yemen-based affiliate and linked to a botched plot to blow up a U.S. airliner with a bomb hidden in a man’s underwear on Christmas Day 2009. His teenage son was also killed in a drone strike.

Targeted killings carried out by remotely piloted unmanned aircraft are controversial because of the risks to nearby civilians and because of their increasing frequency. The United Nations recently launched an investigation into their use.

Most such attacks have been carried out by the United States, but Britain and Israel have also used drones.

Hina Shamsi of the ACLU, which has sued for more information on the drone program, called the memo “profoundly disturbing” and “a stunning overreach of executive authority.”

Shamsi, head of the ACLU’s National Security Project, in a statement called on the Obama administration to release what she said was a 50-page classified legal document on which the 16-page summary is based.

“Among other things, we need to know if the limits the executive purports to impose on its killing authority are as loosely defined as in this summary, because if they are, they ultimately mean little,” she said late Monday.

Stacey Dash 'shocked' by 'fury' over her Romney support

Stacey Dash told Piers Morgan on his CNN show Tuesday night that her support for Mitt Romney has provoked some serious negative feedback.

The Clueless actress tweeted her political opinion on Sunday, writing: "Vote for Romney. The only choice for your future."

She was immediately slammed with Tweets attacking her. One example: "Wait Stacey Dash is voting for Romney? You get a lil money and you forget that you're black and a woman. Two things Romney hates."

And one of the latest came from Samuel L. Jackson, who said, "Wait, did Stacey Dash Really endorse Romney today?! REALLY????! Is she CRA...........??!"

Dash, 46, told Morgan last night, "I really don't understand the fury. I don't get it. ... I was shocked, really shocked. But you can't expect everyone to agree with you."

Dash explained to Morgan that she was a Democrat and voted for Barack Obama in the last election, but now, "I want the next four years to be different." And she says, "It's my right as an American citizen. ... I chose him not by the color of his skin, but the content of his character."

She says that she saw Romney and his wife on Meet the Press, and "they seemed authentic and genuine in what they said about the country. And the need for us to be united and move forward."

Dash said Romney's running mate, Paul Ryan, called her Tuesday and told her she was brave. He tweeted his thanks to her, saying, "Had a great conversation with @REALStaceyDash this afternoon. Thank you for your support!"

And there has been other positive support from fans, too. TV game show host Chuck Woolery tweeted: "Stacey Dash, a beautiful young black woman, demeaned by the left, because she is for Romney. Hollywood, It's a tough place to speak U'r mind."

The board hand-picked by Mayor Michael Bloomberg that must approve his ban of selling large sugar-filled drinks at restaurants might be looking at other targets.

The New York City Board of Health showed support for limiting sizes of sugary drinks at a Tuesday meeting in Queens. They agreed to start the process to formalize the large-drink ban by agreeing to start a six-week public comment period.

At the meeting, some of the members of board said they should be considering other limits on high-calorie foods.

One member, Bruce Vladeck, thinks limiting the sizes for movie theater popcorn should be considered.

"The popcorn isn't a whole lot better than the soda," Vladeck said.

Another board member thinks milk drinks should fall under the size limits.

"There are certainly milkshakes and milk-coffee beverages that have monstrous amounts of calories," said board member Dr. Joel Forman.

Mayor Bloomberg says the drink rules are an attempt to fight obesity in the city. It would limit food service establishments in the city from serving drinks bigger than 16 ounces but would allow refills.

The New York City Restaurant Association is fighting the proposal and is considering legal action of it goes into effect.

After much weeping and gnashing of teeth over the VAWA (which was contested due to the numerous poorly-written add-ons from the Schumer crowd), you'd think that Democrats would be quick to support PRENDA, the Prenatal Nondiscrimination Act, which aims to stop selective-sex abortions. You'd be wrong, though. They just defeated it in the House. Earlier today, Jake Tapper questioned Jay Carney on the President's position:

TAPPER: The House is, I think, this afternoon preparing to take up a bill that would ban gender selection as a factor in abortions in this country. And I was wondering - I haven't a statement of administration policy; I was wondering if the White House had a position on that?

CARNEY: I will have to take that as well. Been focused on other things, but I will get back to you.

Note: The White House got back to me this evening to say the president opposes the bill. White House deputy press secretary Jamie Smith says in a statement: "The Administration opposes gender discrimination in all forms, but the end result of this legislation would be to subject doctors to criminal prosecution if they fail to determine the motivations behind a very personal and private decision. The government should not intrude in medical decisions or private family matters in this way."

On Sunday, the Green Bay Press-Gazette put a link on its Facebook page to an Associated Press story detailing state aid cuts to organizations that help victims of sexual abuse. After that story was posted, a reader left a comment expressing outrage that the state would cut such aid and asserted that perhaps Governor Scott Walker’s wife or children should become victims of sexual assault so the governor could see the how devastating the state aid cuts really are.

The first comment reads:

Another thing Walker has destroyed . . . well just more people that will sign for recall walker now . . . is he really that ignorant to even attack victims at their lowest . . . what a real prize, maybe someone should rape and victimize his wife and daughter if he has any . . . or even sons, then he will wish he supported this service a lot more.

The women, Nancy Butzlaff, appears to have been the first to comment on this particular story on the Press-Gazette’s page. Not too long after her comment, another woman, Jenni Kone-Keeler, suggested that perhaps the governor himself should become the victim of a sexual assault or some assault-related crime. One conservative activist, Lauren Stephens, said that the comments were left up on the Press-Gazette‘s Facebook page for close to nine hours before the paper removed them.

The Butzlaffs
According to Butzlaff’s personal Facebook page, she is married to Robert A. Butzlaff. A search of a Milwaukee Journal Sentinel database found a Robert A. Butzlaff who works for the state of Wisconsin as a corrections officer and made over $63,000 – including overtime pay – in 2010.

Court documents show that Nancy Butzlaff pled no contest in 2007 to a charge that she contributed to the delinquency of a child. By cross checking addresses and names found in other court cases, it appears that this is the same Nancy Butzlaff who advocated that Governor Walker’s family become the victims of sexual assault crimes.

Governor Walker Target of Online Death Threat

Madison, Wisc…] A death threat against Governor Walker was removed from Facebook on Monday, almost three full days after it was initially posted.

“Earlier this morning, Capitol Police became aware of an online death threat directed towards Governor Walker,” said Chief Charles Tubbs in a statement issued this afternoon. “Capitol Police takes any threat directed towards those who visit or work in the Capitol seriously, and Capitol Police investigators have identified and interviewed the responsible individual. Capitol Police does not generally comment on specific security issues.”

Tubbs issued the statement after an inquiry made by a MacIver News Service reporter.

“Rather than recall him… Can we kill him instead? Just curious,” wrote Rachel Cowan on the Recall Walker Kick Off Rally event page on Facebook Friday afternoon.

When someone responded with “He’s signed a bill allowing conceal to carry IN the capitol…..Someone just might get away with it!!!” Cowan then posted: “I’m game.”

The effort to recall Governor Scott Walker is underway and is highly-organized, with dozens of employees set to work out of more than 20 planned regional offices.

The Democratic Party of Wisconsin laid out its initial plan to recall Governor Scott Walker at a volunteer training meeting in Madison last month. DPW is working with a coalition of labor groups under the United Wisconsin umbrella and has divided the state into eight regions and is prepared to have 44 field officers operating out of 22 offices.

During the Senate recall elections in August, state Democrats’ goal was to recall at least three Republican Senators. While they failed to achieve that objective, organizers hope to use the lessons learned from that effort to help them collect the more than half a million signatures needed to trigger a recall election of the Governor.

The death threat was posted on the Facebook page promoting a rally by We Are Wisconsin, the labor union mega PAC that spent more than $18 million on the State Senate recalls earlier this month. We Are Wisconsin is one of the groups helping to organize a Recall Kickoff Rally on Saturday November 19.

Moments after the MacIver News Service contacted the page’s administrators for comments about the threats, the offending post was removed.

Actor Orlando Jones defends tweet calling for Sarah Palin's death

Orlando Jones, best known for his stint at comedy show MADtv, recently tweeted for liberals to kill Sarah Palin and defended his statement, saying, "My tweet hit a nerve. That's good."

Several days ago, Jones wrote on his Twitter account: "Libyan Rebels kill Gaddafi, if American liberals want respect they better stop listening to Aretha & kill Sarah Palin(:"

He then faced a barrage of criticism on his Twitter feed and via his Facebook account. CNN reports Jones responded to a number of Twitter users, "including one that asked why the actor 'thinks it's funny to call for Sarah Palin to be murdered.' Jones replied to the query, 'I don't. I think it's funny that you are so upset about my inane tweet.'"

Jones, also known for being a 7-Up spokesperson in the late 1990s, defended his tweet, recently writing, "My tweet was farcical not funny or a call to action."

On his Facebook Page, Jones went further to fully explain his motive behind the inflammatory tweet: "Any anger directed at me and my right to free speech is an absolute waste of time. I am not a statesman. My comments reflect no political affiliation. It's just me being me, So...he just randomly calls for the death of random people he has no interest in? That's rather sociopathic. in a world that will never comfortably mix political correctness with artistic expression. For that, I offer no apologies, excuses or wisdom."

The Daily Mail obtained this photo of an unidentified male who appears to be defecating on a New York City patrol car during the ongoing “Occupy Wall Street” protests.

The Daily Mail reported:

According to eye witnesses, when people ran to tell nearby police about the man defecating on the squad car they were ignored.

Standing downwind of the piles of rubbish, bankers walking past the man did a double take before hurrying away.

The shocking photo surfaced one day after Brookfield Office Properties — which owns the private Zuccotti Park where the protesters are camped out — railed against the protesters and said the park has reached unsanitary levels as a result of the cramped occupation, CBS reported.

According to the network, the property company cannot simply kick the demonstrators out because the park’s charter allows 24-hour public access.

“Normally the park is cleaned and inspected every week night,” they said in a statement. “Because the protestors refuse to cooperate…the park has not been cleaned since Friday, September 16th and as a result, sanitary conditions have reached unacceptable levels.”

Obama Administration Set to Ban Asthma Inhalers

Remember how Obama recently waived new ozone regulations at the EPA because they were too costly? Well, it seems that the Obama administration would rather make people with Asthma cough up money than let them make a surely inconsequential contribution to depleting the ozone layer:

Asthma patients who rely on over-the-counter inhalers will need to switch to prescription-only alternatives as part of the federal government's latest attempt to protect the Earth's atmosphere.

The Food and Drug Administration said Thursday patients who use the epinephrine inhalers to treat mild asthma will need to switch by Dec. 31 to other types that do not contain chlorofluorocarbons, an aerosol substance once found in a variety of spray products.

The action is part of an agreement signed by the U.S. and other nations to stop using substances that deplete the ozone layer, a region in the atmosphere that helps block harmful ultraviolet rays from the Sun.

But the switch to a greener inhaler will cost consumers more. Epinephrine inhalers are available via online retailers for around $20, whereas the alternatives, which contain the drug albuterol, range from $30 to $60.

The Atlantic's Megan McArdle, an asthma sufferer, noted a while back that when consumers are forced to use environmentally friendly products they are almost always worse:

President Obama's Tax On Soup Kitchens

Yesterday, it was announced that an astounding 1 in 6 Americans are living in poverty. President Obama's response? To demand a tax on donations to soup kitchens and other charities that help people desperately in need. The President's proposal will impact approximately 40% of all the tax deductible contributions, and essentially penalize soup kitchens, hospitals, and churches that provide essential services to those who need them most. It’s no wonder this tax hike has been rejected on both sides of the aisle.

The number of uninsured edged up to 49.9 million, the biggest in more than two decades. The Census Bureau's annual report released Tuesday offers a snapshot of the economic well-being of U.S. households for 2010, when joblessness hovered above 9 percent for a second year. It comes at a politically sensitive time for President Barack Obama, who has acknowledged in the midst of a re-election fight that the unemployment rate could persist at high levels through next year. Ways & Means Ranking Member Sander Levin Has Opposed The President’s Effort To Raise Taxes. Rep. Sander Levin (D-Mich.), who is the ranking member on the tax-writing Ways and Means Committee, delivered a speech in June in defense of many of the same tax deductions Obama is now targeting. "In the case of the charitable deduction, one has to keep in mind that the recipients of the contributions include universities, hospitals, churches and soup kitchens that provide critical services to working families," Levin said. Majority Leader Cantor: It Doesn’t Make Sense To Impose Taxes On Charitable Contributions When The Charities Are The Ones Out There Helping People. We have also found out through looking at his tax proposals, or at least the reports, that his tax proposals are going to impose taxes on charitable contributions and in fact impact at least 40 percent of tax deductible charitable contributions. I don’t think there are many Americans right now who think that’s a good idea. The question is why would we want to put an impediment in the way of the charities accessing funding when the charities are the ones out there helping the people in need right now?
